The company name, registered office and governing law are not filled in yet, and nothing here has been reviewed by a lawyer. What it says about how the service handles data is accurate; the commercial and legal terms are a starting point, not an agreement. Ask us before relying on it.
The agreement
These terms cover your use of WhatsEngage. The company they are with is not named here yet — see the notice above.
You need an account to use the service. You are responsible for what happens under it, including what the people you invite do.
What you may send
Everything you send goes through Meta's WhatsApp Business Platform, so Meta's own policies apply to it as well as ours — in particular its Business Messaging Policy and Commerce Policy. A breach of those can get your number restricted or removed by Meta, and that is outside our control.
You must have a lawful basis to message every contact you load, and you must honour opt-outs. The product enforces STOP and START in every account and cannot be configured to ignore them; that protects the number, it does not replace your own consent records.
Do not use the service for anything unlawful, for messaging people who have not agreed to hear from you, or to impersonate somebody else.
What we charge for
Two separate things: a subscription for the platform, and a per-message price for what you actually send. The per-message price depends on the recipient's country and the message category, because Meta prices it that way.
The price you are shown when you subscribe is the price you keep. Changing our published prices does not re-price an existing subscription.
Message costs are held when a message is sent and charged when WhatsApp confirms delivery. If it fails, the hold is released. Replies inside the 24-hour service window are free.
Prices are quoted and charged in one currency per account. We do not convert between currencies at any point.
Service, and what we do not promise
We aim to keep the service available and will tell you about planned interruptions, but we do not offer an uptime guarantee at these prices.
Message delivery is Meta's. We can show you what Meta told us — sent, delivered, read, failed, and what it billed — and we cannot make a message arrive that Meta did not deliver.
Features change. We will not remove something you rely on without notice, and the changelog is where changes are recorded.
Your data
Your contacts, conversations and campaigns remain yours. We hold them to run the service for you and do not use them for anything else.
You can export them at any time from inside the product, and you can delete them.
How all of that is handled is set out in the privacy policy.
Stopping
You can cancel whenever you want. Cancelling stops the renewal; the plan runs to the end of the period you have paid for.
We can suspend an account that is breaking these terms or Meta's policies, or that is putting other customers' numbers at risk. Where it is not urgent we will tell you first.
After an account closes, exportable data stays available for a short period so you can take it with you, and is then deleted — except the records the privacy policy says outlive it, such as consent events and invoices.
The parts that still need a lawyer
Refund terms, limitation of liability, indemnities and governing law are not stated here because stating them wrongly would be worse than stating them late. They will be added before the service is sold, and you will see them before you are charged.
